Terms of Service

By using the Wishfall website (including its associated domain names, web hosting and other online infrastructure), you signify that you have read, understand and agree to be bound by these Terms of Service and the Wishfall website Privacy Policy. If you do not agree to abide by these or any future Terms of Service, you are not permitted to use or access the Wishfall website or related Wishfall services.

If you are determined by Wishfall's administrators to have violated these Terms of Service, your account will be terminated and you will be permanently banned from Wishfall and its related services. Wishfall's administrators have no obligation to provide prior notice or to supply an explanation. You acknowledge that your use of this website is at your own risk.

Definitions. "Wishfall / We / Us / Our" relates to Lione Ltd trading as Wishfall. "User / You / Your" - Anyone using the Wishfall website.

Restrictions. The Wishfall website is intended solely for persons who are sixteen (16) years of age or older. Any registration by, use of, or access to the Wishfall website by anyone under sixteen (16) years of age is unauthorised and in violation of these Terms of Service.

Copyright: Website Design. You acknowledge that Wishfall owns all rights, title and interest in all Wishfall branding and navigational content on the Wishfall website, including (but not limited to) the Wishfall logo, text, graphics and files, and Wishfall's selection and arrangement (the "Content"), and you agree not to modify, copy, distribute, frame, republish, display, post, transmit, or sell the Content, except as may be expressly permitted by Wishfall. You may not republish the Content or incorporate the information into any database or compilation.

Trademarks. All trademarks, logos, trade dress and service marks on the Wishfall website are trademarks of their respective owners or Wishfall and may not be copied, imitated, or used, in whole or in part, without express written permission.

Third-Party Sites. The Wishfall website contains links to other websites operated by unrelated parties. These website links are provided for your convenience and reference only. Wishfall does not control these sites and is not responsible for their contents. Our inclusion of these links does not imply any association with these sites or any endorsement or approval of the services, merchandise, materials or contents available from or on these sites. By accessing third-party sites via the Wishfall website, you do so at your own risk. You should review the terms and privacy policies of these sites, as they may differ from ours. We do not control or review the usage terms or privacy practices of third-party sites.

Endorsement. Wishfall contains descriptions of or references to products, services, and firms. These references do not imply our endorsement of those products, services or entities. Under no circumstances shall any of our providers be liable for any loss or damage caused by a user's reliance on or exposure to information obtained from or contained on Wishfall. You are responsible for evaluating the information and other content available through the Wishfall website, and any products, services or firms referenced.

Advertising. Wishfall is a family safe network. We reserve the right to reject any advertising campaign containing, or linking to, pornography, nudity, sexuality, spam, hate, racism, copyright infringement, illegal activities or illegal software. This includes (but is not limited to) websites containing adult related products or services. Wishfall do not accept adverts promoting cigarettes, e-cigarettes, vapour or other related products. We also reserve the right to refuse any link that redirects to different web address, has heavy amounts of advertising, breaks out of frames, contains pop-ups or resizes to fullscreen.

Complaints. Wishfall is not responsible for the content, management, honesty or uptime of websites, apps, products or services advertised within the Wishfall game or elsewhere on the Wishfall website. You agree to visit, invest or take part in other activities at your own risk. However, following a complaint made to Wishfall, we reserve the right to remove and/or blacklist any website or link, with no compensation to the advertiser for remaining unused advertising credits or time purchased. This includes (but is not limited to) the reasons listed in Advertising, criminal behaviour or unacceptable activities.

Prohibited Activities. You are prohibited from artificially generating, or hiding/masking the true source of, traffic, hits, impressions, clicks, visitors, visits or any other interactions, by any means, to any Wishfall image, link or website. Sources are accepted, approved, credited, blacklisted, blocked and/or redirected solely at the discretion of Wishfall' administrators. Usage limits are in place to protect resources and to prevent system abuse.

Products and Services. Wishfall products and services will only be supplied following receipt of full payment via PayPal. All of Wishfall' products and services include advertising. If for any reason other Wishfall features become unavailable, you agree to accept the Wishfall product or service as an advertising purchase.

Information. By joining Wishfall you agree that your non-identifiable information (member number, etc) may be published on the Wishfall website and elsewhere.

Abuse. Wishfall has a zero tolerance policy towards abuse of any kind. Any person found to be sending unsolicited messages (spam) by any means, including (but not limited to) email messages, forum posts and text messages will have their Wishfall account deleted. Furthermore, any person that sends threatening or otherwise abusive messages to our staff, members and/or advertisers will have their Wishfall account permanently deleted.

Refunds. Due to the nature of our service refunds are generally not available. However, we will work with advertisers independently, on a case by case basis, to resolve any issues.

Inactive Accounts. If you have not logged in to Wishfall for 18 months (547 days) your account will be locked and it scheduled for deletion after 24 months (730 days).

Taxes. It is your responsibility to determine what, if any, taxes apply. It is solely your responsibility to assess, collect, report, or remit the correct tax to the relevant tax authorities. Wishfall is not obligated to, nor will Wishfall determine whether taxes apply, or calculate, collect, report, or remit any taxes to any tax authority arising from your use of Wishfall.

Service. You acknowledge that this service can be revoked at any time for any reason Wishfall's adminstrators see fit with no obligation to provide any form of compensation for products/services purchased. Although we make a reasonable effort to provide a high quality service, we do not provide any warranty and make no guarantees of any kind regarding the dependability, accuracy, uptime or timeliness of this service.

Liability. Wishfall is not responsible for any incorrect or inaccurate Content posted on the Wishfall website regardless of the cause or source, or for the conduct, online or offline, of any user or other user of the Wishfall website. We also assume no responsibility for:


Under no circumstances will Wishfall be responsible for any loss or damage incurred or resulting from anyone's use, including your use, of the Wishfall website, any Content posted on the Wishfall website or communicated to users, or any interactions between users of the Wishfall website, online or offline. WISHFALL AND THE CONTENT ARE PROVIDED "AS-IS" AND WISHFALL DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

IN NO EVENT WILL WISHFALL BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS AND LOST DATA), OR FOR ANY DAMAGES IN EXCESS OF THE AMOUNT PAID BY YOU TO WISHFALL, ARISING FROM YOUR USE OF WISHFALL, REGARDLESS OF THE CAUSE (INCLUDING NEGLIGENCE) AND EVEN IF WISHFALL WAS AWARE THAT SUCH DAMAGES MIGHT OCCUR. Some US states limit or prohibit the limitation of liability in certain cases, so these limitations may not apply to you.

You agree to indemnify and hold Wishfall and its owners, subsidiaries, users, officers, agents, partners and employees harmless from any damage, liability, claim, or expense (including attorneys' fees) arising out of or in connection with your use of the Wishfall website, your violation of these Terms of Service, or your violation of the rights of a third party or any law.

These Terms of Service, and the accompanying Privacy Policy, constitute the entire agreement between you and Wishfall regarding the use of the Wishfall website and supersede any prior agreements between you and Wishfall on the same subject. Wishfall's failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If any provision of these terms is held invalid, the remaining terms shall continue in full force and effect.

Disputes. If there is any dispute about or involving Wishfall you agree that the dispute will be governed by the laws of the United Kingdom, as they apply to residents within the country of England. You also agree to the exclusive jurisdiction and venue of the courts of England and waive all defenses of lack of personal jurisdiction or that the forum is not convenient, except that Wishfall may bring suit against you in any court that has jurisdiction over your person or property. Any cause of action by you with respect to the Wishfall website or its owners must be instituted within 180 days after cause of action or be forever waived and barred.

Revisions. We may change these Terms of Service from time to time (for example, if the law changes). Any changes will be immediately posted on this page and Wishfall website users will be deemed to have accepted the terms of the Terms of Service on their first use of the Wishfall website following the alterations.
